Government fixes privatization procedure for non-living premises

The institution, which administer the privatization of the state property are the Government with its central public property privatization organs, as well as local authorities of the second and the first levels.

Such specification was made by the Government in the Regulations on the Privatization of non-living premises, which are leased out.

Commenting on the document, Minister of Economy and Trade Igor Dodon said that the division of terms of reference is a principal position.

“If earlier local administrations, which intended to privatize one or other object, which was on their balance, had to receive a respective permission from the Government, the Privatization Agency, from now on there will be no need in this. We offered decentralization and this principle was embodied in the Law on the Privatization and Administration of Public Property, approved in May 2007. Any local power organ is empowered to offer its assets for sale and to transfer privatization earnings to the local budget”, Dodon said.

The Regulations do not envisage any restrictions concerning the privatization of non-living premises, which are leased out, but it obliges the owner (central or local authorities) to observe the legislation in force. In the first place, the matter is of conducting public auctions or privatization tenders, participation of several candidates, selection of winners depending on prices and conditions.

The document envisages also a method of forming privatization commission, including on the level of local authorities, as well of à procedure of transferring non-living premises to associations of the owners of privatized apartments, list of documents to be submitted, method of payments for the privatization process and other aspects.  // Infotag
