Termocom won process initiated against Municipal Council of Chisinau
The Court of Appeal of Chisinau solved the case of the thermal energy supplier Termocom against the Municipal Council of Chisinau (CMC) in the favour of the first. Termocom requested the court to cancel the 4 December decision of CMC, when the tariff of 540 for the thermal energy was authorized.
The CMC decision of returning to the old tariff of 233 lei for a Giga-calorie was logically and juridically groundless, and the court confirmed this fact, according to Termocom Juridical Direction Head Veaceslav Eni. The municipality is going to dispute the court decision at the Supreme Court of Justice, according to Deputy Mayor Mihai Furtună. “The actions of Termocom are illegal and incorrect, as the 25 January, 2007 decision of increasing the tariff was approved against the related legislation, being adopted without financial coverage. The municipal budget does not have resources to cover the tariff difference”, Furtună said. On January 25, the former counselors decided to increase the tariff for the thermal energy from 233 lei to 540 lei/a Giga-calorie. They also decided that the tariff for the house consumers to stay the same, and the price difference to be covered by the municipal budget.
